Do I need a custodian in Canada?
The short answer: if your child is under 17 and coming without a parent, yes. Between 17 and the age of majority, the visa officer decides. Here is how it works.
The IRCC rules
- Under 17: a Canadian custodian is required unless a parent or legal guardian comes with the child for the whole stay.
- 17 up to the age of majority (18 or 19 by province): the officer decides case by case. They look at level of study, maturity, finances and how reachable the parents are. High school students should normally have a custodian.
- A parent comes too: no custodian is needed. If only one parent comes, bring a signed consent letter from the other parent.
- Grades K to 12 are exempt from the Provincial Attestation Letter in 2026 and fall outside the provincial study permit caps.
The custodianship declaration (IMM 5646)
The form has two pages signed in two countries. The custodian signs before a notary or lawyer in Canada. The parents or legal guardians sign before a notary in their home country. Both original pages go with the study permit application.
Mistakes that delay or refuse a file
- Notarizing a page in the wrong country
- Only one parent signing when both have custody
- A custodian who is not a Canadian citizen or permanent resident
- Names or dates that don't match the passport or the letter of acceptance
School boards add their own rules
Many boards require a custodian for every international student, even after 18. Some require the custodian to be 25 or older (TDSB) and to live near the school. We meet these requirements across the Greater Toronto Area.
